Any work at your property is governed by its own separate written agreement covering that work, including what is being built, price, schedule, materials, change orders, payment terms, and any warranty. If a detail matters to you, it belongs in that written agreement, not in an email, not in a phone call, and not on this page.
Nothing on this site is an offer, a quote, or a commitment to perform work. A price becomes a price when it is in that written agreement, and not before. Anything you read here about cost, timing, or availability is general and subject to change.
How the work gets done. Work at your property is carried out by licensed contractors in our network, matched to your job by the work involved, where you are, and what they do. They are independent businesses, they carry their own licensing and insurance, and your agreement for the work is with the contractor who performs it. That agreement is separate from these terms.

Codes change. Cities read them differently. Your lot, your setback, your corner, your HOA, and your existing wall all affect the answer. The City and its inspector decide what is permitted and what passes. This website does not decide it, and neither does an opinion given at the curb.
Pool barrier requirements deserve their own sentence: what we publish is a general summary of state requirements, local rules can be stricter, and the barrier that protects a child is the one that actually passes inspection. Verify with your city before you build.
We do not handle retaining walls. A retaining wall holds back soil and is engineered for lateral load. That is a different specialty with a different license class, and nothing on this site should be read as guidance on it.

Photographs and documents you send us. You may send photos of a wall, a fence, or a gate, and you may send community standards or other documents. By sending them you confirm you have the right to do so, and you give us permission to use them for the purpose of assessing and carrying out your request. Do not send anything confidential that you would not want handled by ordinary business email.
Nothing you send creates an obligation on us to take the work, and nothing we say in reply is a quote unless it is in the separate written agreement described above.
When you submit the form or call the number on this site, you agree that we, the contractor matched to your request, and anyone acting on our behalf, may contact you by phone, text, and email about your request, including by automated or prerecorded call and by automated text.
Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies.
How to stop. Reply STOP to any text, tell us on any call, or email us at team@tempefencecompany.com and we will stop. You may withdraw consent at any time and by any reasonable means.
Calls may be recorded for quality and training purposes.

The text, layout, design, graphics, photographs, and code on this site belong to Trade Star Local, LLC or to the people who licensed them to us. So do the Tempe Fence Company name and logo.

What these limits are about. They are about this website, its content, and these terms. Liability relating to construction work at your property is governed by the separate written agreement covering that work, not by this page.
Contractors are independent businesses. A contractor matched to your request carries its own licensing and insurance and is responsible for the work it performs. To the fullest extent the law allows, we are not liable for a contractor's acts or omissions, including defective work, delay, damage to property, injury, code violations, or a failed inspection. We are not a party to your agreement with a contractor.
We are not liable for indirect losses. That includes lost profits, lost data, loss of use, cost of substitute services, and incidental, consequential, special, or punitive damages. It applies even if we were told those losses were possible.
We are not liable for reliance on general information. Nothing on this site is a code determination, and a permit, height limit, or pool barrier question is decided by your city and its inspector.
A cap on what we could owe. If we are found liable to you for anything arising out of this site or these terms, our total liability is limited to one hundred US dollars ($100).
Some jurisdictions do not allow certain exclusions or limits. Where that is the case, the limits above apply as far as the law permits and no further. Nothing here limits liability that cannot be limited by law, including for fraud, personal injury caused by negligence, or anything else that may not be excluded.
Where to take a complaint about work. A dispute about work performed at your property is between you and the contractor who performed it, under the written agreement covering that work. Separately, the Arizona Registrar of Contractors handles complaints against licensed contractors, and small claims court is available for smaller amounts. We want to hear about a bad experience regardless.
You agree to defend, indemnify, and hold harmless Trade Star Local, LLC, Tempe Fence Company, and our officers, members, employees, and agents from any claim, loss, liability, or expense, including reasonable attorney's fees, arising out of:
These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules.
Any dispute between you and us relating to this site or these terms will be brought in the state or federal courts located in Maricopa County, Arizona, and you and we both agree to those courts having jurisdiction.
If one part fails, the rest stands. If a court finds any part of these terms unenforceable, that part is limited or removed and the remaining terms stay in effect.
No waiver. If we do not enforce a term right away, we have not given up the right to enforce it later.
Whole agreement. These terms and the Privacy Policy are the entire agreement between you and us about this site. They do not replace or modify any separate written agreement covering work at your property.
Assignment. We may assign these terms to a successor or an affiliate. You may not assign them.
Survival. The disclaimers, limitation of liability, indemnification, and governing law sections survive after you stop using the site.
We may update these terms. When we do, we change the "last updated" date at the top of this page. Continuing to use the site after a change means you accept the updated terms. If you do not accept them, stop using the site.
